General terms and conditions of sale

1. Object

The following general sales conditions govern the distance selling of tickets to national and international entertainment and/or cultural events through the website https://www.villaarconati-far.it. The sale is carried out by Fondazione Augusto Rancilio. The issuance of tickets is done through the MTICKET ver 1.7 platform owned by MTicket S.r.l. and granted for use to Fondazione Augusto Rancilio.

2. Responsibility

The selection of Events for which the Manager allows the Purchase is at the Manager's total and unquestionable discretion. The Manager receives information regarding the Events and presents them to the User on the Website as they are provided by the Organizers of the Events and cannot in any way be held responsible for any inaccuracies contained therein

  • pre-sale of tickets
  • provision of necessary and accessory services related to pre-sale

The User who uses these Services is required to comply with all the General Conditions listed therein, which must be read and approved before completing the purchase process. These conditions may be modified at any time. Any changes will be effective upon their publication on https://www.villaarconati-far.it in the "Terms and Conditions" section, found in the footer of each page of the website. Users are therefore invited to regularly access the Website and consult the most updated version of the General Conditions before making any purchase. Each purchase will be governed by the General Conditions in force at the time of the purchase.

3. Definitions

The following definitions apply to these General Contract Conditions, it being understood that the definitions in the plural will apply to the relevant term in the singular and vice versa:

  • Sales platform: MTICKET ver 1.7 owned by Marketing Multimedia S.r.l., deemed suitable by the Italian Revenue Agency, in its hardware and software components, for issuing access tickets, with resolution n. 2022/384751 dated October 13, 2022
  • User of the sales platform is Fondazione Augusto Rancilio, with registered office at Via Madonna Fametta, 1 Castellazzo di Bollate - Italy, which is in charge, on behalf of the event organizer, of selling Access Tickets to the event through the website https://www.villaarconati-far.it (hereafter referred to as the "Website")
  • Event: refers to the exhibition, show or performance that the holder of the access ticket can attend
  • Event location: refers to the set of buildings and lands that constitute the venues
  • User: is the individual who electronically purchases the Access Tickets for the Event from the Organizer
  • Holder of the access ticket: is the individual who legitimately and in accordance with these General Contract Terms holds an Access Ticket purchased by the User
  • Access ticket: is the document issued by the Organizer through the sales platform that authorizes the Holder of the Ticket to access the Event location
  • Contract: is the agreement between the User, Fondazione Augusto Rancilio, and the event organizers that regulates the process of purchasing
4. Online purchasing

In order to complete a purchase, the User must, in order:

  • select the desired event
  • select and/or confirm the desired date and time of participation in the event
  • select, if applicable, the type of seat
  • select the price type based on the indications provided by the organizer (eligible for discounts)
  • add the chosen tickets to the shopping cart
  • proceed with another or more purchases, if applicable
  • select, if applicable, the type of ticket delivery or shipping
  • check the summary of the purchase data
  • enter all the required identification, payment, and possible shipping information correctly
  • proceed with the final confirmation of the transaction

Please note that from the moment the tickets are added to the cart, the User has 20 minutes to complete the Purchase with payment confirmation. After the time expires, the tickets will be removed from the cart and will be available for public sale again. To complete the purchase, it will be sufficient to enter personal data during the checkout phase, or, conversely, if the type of event being purchased requires it, the user will be required to register on the site.

In detail, as required by the amendment to the Budget Law (n. 145 of 30 December 2018) for events with a capacity of more than 1000 seats the user who purchases tickets online must be identified. The legislation applies exclusively to certain categories of events, such as, but not limited to, pop music concerts.

5. Registration to the Site

Registration to the Site is free. To register on the Site and create the related account, the user must fill in the appropriate form, entering the required personal data, as well as an email address and a password. It is absolutely and strictly prohibited for the user to enter false, invented, fantasy, incomplete, or otherwise inaccurate identification data for the purpose of registering on the Site, and/or in any way not corresponding to the truth or referring to third parties. It is also prohibited for the user to create more than one account on the Site referring to the same natural and/or legal person, and/or to companies and/or entities of any kind, even by usingsponding data.

Registration to the Site allows the user to perform, through the reserved and personal account, among other things, the following activities::

  • make purchases on the site;
  • check the status of the most recent orders and view the archive of all orders placed;
  • manage your personal data and modify it at any time;
  • change the password.

During the registration to the Site, the user can choose to validate their phone number through the One Time Password (OTP) validation code sent to them via SMS. The validation of the phone number is provided for by Law no. 145 of December 20, 2018, amending article 1, paragraph 545 et seq. of Law 232/2016 (Budget Law 2017), which requires that the user purchasing admission tickets through online channels on official ticketing websites be identified through OTP validation. If the user chooses not to validate their phone number during the registration to the Site, they must do so during the procedure of the first purchase order. The registration credentials (email address and password) must be kept with utmost care and attention and may only be used by the user. The user undertakes to keep them secret and to ensure that no third party has access to them.

6. Ticket Prices
  • VTicket value: determined by the Organizer and includes two fees, namely the cost of the ticket to attend the event and any presale fees. The presale fee is a fee that is fiscally attributable and due to the Organizer himself, as stipulated, regulated, and clarified by the Ministry of Finance. The Organizer reserves the right to modify the price of the admission tickets at any time, provided that in the case of purchase through the Website, the price charged to the user will be the one indicated on the Website and in the Order Summary, and any subsequent variations (whether increasing or decreasing) will not be taken into account after the transmission of the order.
  • Agency fees: the fee set by the reseller as remuneration for the services provided, and due and attributable fiscally to the reseller. The agency fee will never be refundable, even in the event of the event's cancellation.
  • Additional expenses: in some cases, depending on the choices made by the user, additional expenses such as ticket shipping, any insurance coverage, etc. may be added to the charges.
  • Total amount: sum of the value of all admission tickets plus any agency fees and additional expenses. All prices indicated are expressed in Euros and must be considered inclusive of VAT.
  • N.B. The ticket value, presale, agency fees, and any additional expenses are clearly indicated during all stages of the purchase, in the order summary, and in the order confirmation email.
7. Payment Methods

Payment Methods The payment methods for the purchase of admission tickets are those that are each time visible and made available on the Website. MTicket uses secure payment services through the following payment gateways: Nexi, PayPal, and Satispay. Payments will be managed through secure connections, and the data necessary for the transactions will be transmitted directly to the payment manager without passing through the servers used by MTicket. Therefore, the Manager is unable to access any sensitive data regarding the transaction or make any intervention in the event of a denied transaction for any reason. In the event of a refund, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; in case this is not possible, the refund will be made by bank transfer, in which case Fondazione Augusto Rancilio will request the necessary bank details from the user to process the refund.

8. Delivery of Tickets and Access to the Event.

The delivery of admission tickets purchased on the Website can be made, depending on the characteristics of the event, the user's choice, and upon payment of the related costs, if applicable, using the following different methods:

  • delivery through immediate printout of the admission ticket sent in PDF format;
  • pick-up at the event venue or designated location

Both digital and paper formats. All users must have a valid admission ticket to access the event. The admission ticket is exclusively valid for the Event for which it was issued, on the day and time indicated therein. The Organizer has the right to refuse access to the Event venue due to irregularities in the admission ticket or Purchase Confirmation or in the event that one of the two is lost, stolen, destroyed, damaged, deteriorated, or even partially illegible as presented by the Customer not in perfect condition; the Organizer also has the right to carry out checks on individuals for security reason.

9. Postponed or Cancelled Event

In the event of cancellation, rescheduling, or changes to an Event for which the User has made the Purchase, the rules and methods adopted from time to time by the Organizer, who is solely responsible for the Event, will apply according to the law. In turn, the Manager will communicate all the changes and information provided by the Organizer to the User as soon as possible via email. In the event of cancellation of the Event, Fondazione Augusto Rancilio will proceed with the refund to the user according to the methods and timing decided by the Organizer. The user is reminded that the Organizer, in the event of cancellation of the Event, reserves the right to retain the presale fee and that, even in this case, the Manager is completely unaware of the Organizer's decisions. If partial and/or total refunds of tickets are provided or replacements with other tickets are offered, Fondazione Augusto Rancilio will act like any other presale agency, refunding the value of the tickets or part of this value (according to the Organizer's provisions), net of agency fees and payment commissions. In the event of non-implementation of the Event, the refund established by the Organizer can be issued exclusively by returning the intact admission ticket to the Manager, in order to allow its fiscal annulment as provided by law. In the event of failure to return the intact ticket within the time limits established by law, nothing will be refunded, and the Organizer will be obliged to fulfill the tax obligations for the unreimbursed amounts. In any case of cancellation and/or rescheduling of the Event, the Customer can still contact the Organizer to assert all their rights.

10. Exclusion of the Right of Withdrawal

With the payment, the Buyer concludes the purchase, accepts, and confirms the content related to the Event. Before concluding it, the Buyer undertakes to carefully verify all the data related to it (for example, the event date, types of chosen seats, and anything else). This data cannot be modified anymore. In the case of online sales, the right of withdrawal under article 59 (exceptions to the right of withdrawal under articles 52 to 58 of the Consumer Code), paragraph 1, letter n) of the Consumer Code (services relating to leisure activities if the contract provides for a specific date or period of performance) is excluded. In this regard, reference is also made to the provisions of Legislative Decree no. 185 of May 22, 1999, art. 7, paragraph 1, letter b) and Legislative Decree no. 206 of September 6, 2005, art. 55, paragraph 1, letter b), and subsequent amendments. Therefore, renunciations, requests for partial or total refund, cancellations, changes of dates and visiting and entry times, changes of seat types and prices for any valid reason by the User after the purchase has been concluded and confirmed are not possible. Specifically, in compliance with current regulations, it is reminded that the sale of access tickets for shows and entertainment includes, at the same time as payment, the issuance of the same tickets (with the assignment of fiscal seals) through an automated, certified, and authorized ticketing system by the Revenue Agency. The tickets are valid exclusively for the show's date and for the type of seat and price for which they were issued. Therefore, in the event of renunciation, even for any justified and serious reason or impediment by the Buyer to access/participate in the Event, no refund, not even partial, will be granted by the Manager, neither for the cost of the event, nor for presale and agency fees, nor for other costs incurred by the Buyer on their own behalf (for example, travel or accommodation expenses).

11. Applicable Law and Jurisdiction

The Contract is considered concluded in Italy and is subject to Italian law.

For any dispute, the jurisdiction of Milan is exclusively competent, except for disputes with Consumer users, for which the jurisdiction of the place where the user resides or has elected domicile is exclusively competent.
